Thanks for using this wireless internet services. The Service is provided by Federalberghi Torino – CF 80088480019 located at VIA VINCENZO GIOBERTI 11 10128 – TORINO (TO) and TURISMO ALPMED SRL P.I 10807510010 located at VIA G. POMBA 23 TORINO (TO) (hereinafter both referred as “the Company”) through We4Guest systems by AMG s.r.l. as Data Processor. 
By using the Service, you are agreeing to these Terms & Conditions of Use. Please read them carefully.

Acceptance of the Terms

By clicking on “I AGREE” on the service sign-up page, you represent that: 
1. You have read, understand and agree to the Terms
2. You are at least 18 years of age
If you do not agree to the Terms, you may not use the Service. Your electronic acceptance of the Terms by clicking on the “I AGREE” on the sign-up page has the same effect as if you had actually signed the Terms. The effective date of these Terms is the date that you click on
“I AGREE”.

Description of the Service

The Company’s Service provides you with access to the Internet via Wi-Fi access points using an 802.11 standard (“Wi-Fi hotspots”). To access the Service, you must have a device that is compatible with the specific Wi-Fi equipment deployed at the Wi-Fi hotspot. 

The service is intended for the limited purposes of allowing access to the public Internet for e-mail, web browsing, download files via the ‘ftp’ protocol typically implemented in such web browser programs and for purposes otherwise consistent with the Terms. The Service is not intended for high-bandwidth applications such as streaming of video.

Security

The unsecured nature and ease of connection to public Wi-Fi hotspots increases the risk that unauthorized persons can access your phone, laptop or other device or your communications over the Wi-Fi network. Wi-Fi customers should take precautions to lower the security risks. The Company encourages you to observe standard security practices. You should ensure that computer hard drives are not shared; that laptops have firewall protection; and that security software is installed, functional and updated on your device. The Company recommends that you avoid transmitting or accessing sensitive personal information over the Wi-Fi network, and that you only connect to known Wi-Fi hotspots. 

Use of the Service 

The Company is not responsible for any impact to or interruption of business resulting from the use of the Service. You agree not to use or attempt to use the Service for any fraudulent, unlawful, harassing, or abusive purpose or so as to damage or cause risk to the Company, its business, reputation, employees, other users,
equipment or any third person.  
In case of improper uses, the Company may suspend or stop providing the Services to you if you do not comply with our Terms.

Fee for the Service 

Where applicable, you agree to pay all charges and fees related to your use of the Service, including taxes, fees, surcharges or other assessments applicable to the Service.

Monitoring of the Service

The Company has no obligation to monitor the Service, but may do so and disclose information regarding use of the Service for any reason it deems legitimate, in its sole discretion, including the possibility to: satisfy laws, regulations or governmental or legal requests; operate the Service properly; or protect itself and its customers. Likewise, the Company may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong. 

Modifications to the Service

The Company reserves the right to modify or discontinue, temporarily or permanently, at any time and from time to time, the Service (or any function or feature of the Service or any part thereof, including but not limited to rates and charges) with or without notice. You agree that the Company will not be liable to you or to any third party for any such modification, suspension or discontinuance of the Service.

Termination of the Service

Without prior notice, the Company may terminate these Terms or your access to the Service for any reason, including, without limitation, if the Company, in its sole discretion, believes you have violated these Terms. 

Privacy protection

The Privacy Policy explains how the Company treats your personal data and protect your privacy when you use the Service. By using the Service, you agree that the Company can use such data in accordance with its Privacy
Policy.

Disclaimer of warranties and limitation of liability

The Company does not control any materials, information, products, or services on the internet. The internet contains unedited materials, some
of which are sexually explicit or may be offensive to you. The Company has no control over and accepts no responsibility for such materials.
You assume full responsibility and risk for use of the service and the internet and are solely responsible for evaluating the accuracy, completeness, and usefulness of all services, products and other information, and the quality and merchantability of all merchandise provided through the service or the internet.
This Service is provided on an “as is” and “as available” basis. The Company
does not warrant that the Service will be error-free, or free of viruses or other harmful components. The Company makes no express warranties. You waive all implied warranties including, but not limited to, warranties of title, non infringement, merchantability, and fitness for a particular purpose regarding any merchandise, information or service provided through the Company or the internet. You expressly
acknowledge that there are risks, and assumes all responsibility related to, the security, privacy and confidentiality risks inherent in wireless communications and technology. The Company does not make any assurances or warranties relating to such risks. No advice or information given by the Company or its representatives shall create a warranty. The Company and its employees are not liable for any costs or
damages arising, either directly or indirectly, from your use of the service or the internet, specifically including any indirect, incidental, exemplary, multiple, special, punitive or consequential
damages.

Indemnity

You agree to defend, indemnify, and hold the Company harmless from and against any and all claims, demands, actions, liabilities, costs or damages arising out of your use of the Service or of any your violation of these Terms. You further agree to pay the Company reasonable attorneys fees, experts fees and other costs in any action or claim under these Terms.

About these Terms

The Company may, at its sole discretion, modify the Terms. Such modifications shall be binding and effective upon the date of posting. You agree to review the Terms prior to each use of the Service to maintain awareness of any modifications. By continuing to use the Service after such postings, you agree to accept and agree to any and all such modifications.
These Terms are governed by Italy law without regard to conflict of law provisions. The courts located in Italy alone have jurisdiction over all disputes arising out of or related to these Terms and the Service.

Grazie per aver scelto il nostro Servizio di Internet wireless. Il Servizio è fornito da Federalberghi Torino – CF 80088480019 localizzata in VIA VINCENZO GIOBERTI 11 10128 – TORINO (TO) e TURISMO ALPMED SRL P.I 10807510010 localizzata in VIA G. POMBA 23 TORINO (TO) (di seguito entrambi indicati come “la Società”) attraverso i sistemi We4Guest fornito da AMG s.r.l. nella ruolo di Responsabile del trattamento (Data Processor).
L’utente, accedendo al Servizio, accetta e si impegna a rispettare i presenti Termini e condizioni d’uso. Pertanto, è necessario leggere attentamente quanto segue.

Accettazione dei Termini e condizioni d’Uso

Completando la procedura di registrazione e cliccando sul pulsante “ACCETTO” tu (l’utente) dichiari: 
1. Di aver letto, compreso ed accettato i Termini e condizioni d’uso del Servizio, qui di seguito espressamente descritti.
2. Di aver compiuto la maggiore età, ovvero 18 anni
In caso di mancata accettazione delle suddette condizioni, tu (l’utente) NON sei autorizzato ad accedere al Servizio. Completando la procedura di registrazione e cliccando sul pulsante “ACCETTO”, tu (l’utente) riconosci che il contratto è valido come qualsiasi contratto sottoscritto e firmato.

Descrizione del Servizio

La Società eroga il Servizio di accesso ad Internet tramite punti di accesso Wi-Fi che utilizzano lo standard 802.11 (‘Hotspot Wi-Fi’). Per accedere al Servizio, è necessario disporre di un dispositivo che sia compatibile con le apparecchiature Wi-Fi utilizzate per realizzare l’hotspot Wi-Fi. Il Servizio ha lo scopo di fornire l’accesso alla rete Internet per applicazioni di tipo tradizionale, quali invio di e-mail, navigazione sul web, download di file tramite protocollo ‘ftp’ ed altri scopi coerenti con i presenti Termini e condizioni d’uso. Il Servizio non ha la finalità di garantire applicazioni a banda larga come lo streaming di video.

Sicurezza

La natura di per sé aperta e la facilità nel collegamento ad un hotspot Wi-Fi pubblico aumentano il rischio che persone non autorizzate possano accedere al tuo smartphone, notebook o altro dispositivo o alle
informazioni scambiate su rete Wi-Fi. I clienti del Servizio Wi-Fi devono prendere le adeguate precauzioni per ridurre i rischi legati alla sicurezza. 
La Società invita a rispettare le norme di sicurezza standard in ambito di comunicazioni wireless. E’ necessario assicurarsi che le informazioni archiviate sui propri dispositivi non siano condivise; che i notebook abbiano una protezione firewall e che sia installato un antivirus aggiornato e funzionale.

La Società consiglia di evitare la trasmissione o l’accesso a dati sensibili tramite rete Wi-Fi, e di connettersi a hotspot Wi-Fi di conoscenza.

Utilizzo del Servizio 

La Società non è in alcun modo responsabile di eventuali perdite o danni dovuti all’uso del Servizio.
Accettando i presenti Termini e condizioni d’uso, si accetta di non utilizzare il Servizio per qualsiasi scopo fraudolento, illegale, offensivo o abusivo o che in alcun modo possa arrecare danni o causare rischi alla Società,
alle sue attività, reputazione, dipendenti, o altri utenti, dispositivi o a qualunque terza persona.
La Società può sospendere o interrompere la fornitura del Servizio, in caso di uso improprio dello stesso in accordo con quanto previsto in questi Termini e condizioni.

Costo del Servizio 

Quando richiesto, si accetta di pagare tutte le spese e le commissioni relative all’uso del Servizio, comprese le tasse, imposte, supplementi o altre voci applicabili al Servizio.

Monitoraggio del Servizio

La Società ha il diritto, ma non l’obbligo, di monitorare il Servizio e di divulgare informazioni riguardanti l’utilizzo del Servizio, per qualsiasi motivo legittimo, a propria esclusiva discrezione, inclusa la possibilità di: soddisfare disposizioni legislative, regolamentari o giuridiche; ottimizzare la gestione del Servizio; proteggere se stessa e i propri clienti. Allo stesso modo, la Società può collaborare con le autorità legali e / o terze parti nel controllo e investigazione di ogni crimine sospetto o di illeciti civili.

Modifiche del Servizio

La Società si riserva il diritto di modificare o interrompere, temporaneamente o definitivamente, in qualsiasi momento e di volta in volta, il Servizio ( o qualsiasi funzione o caratteristica del Servizio o qualunque parte di esso, compresi ma non limitatamente ai costi ad esso applicati), con o senza preavviso. L’utente accetta che la Società non sarà responsabile nei confronti dell’utente o di terze parti per tali modifiche, sospensione o interruzione del Servizio. 

Cessazione del servizio

Senza preavviso, la Società, a propria esclusiva discrezione, può risolvere i presenti Termini e condizioni e sospendere l’accesso al Servizio per qualsiasi motivo, anche in caso di uso improprio, effettivo o presunto, del Servizio o mancato rispetto dei presenti Termini e condizioni.

L’informativa sul trattamento dei dati personali illustra come la Società raccoglie e protegge i dati personali degli utenti nel rispetto della tutela della privacy. Utilizzando il Servizio, tu (l’utente) accetti che la Società possa trattare tali dati in conformità con la sua politica sulla privacy.

La Società non fornisce alcuna garanzia rispetto a tali rischi. Nessun suggerimento o informazione forniti da parte della Società o dai suoi rappresentanti, creerà una garanzia. La Società e i suoi dipendenti non sono responsabili di eventuali danni di qualsiasi tipo, compreso danni diretti, indiretti, generali, incidentali, speciali, consequenziali, esemplari e punitivi. 

Indennità

L’utente accetta di difendere, indennizzare e ritenere innocente la Società, da e contro tutti i reclami, danni, perdite, costi e spese, compresi ragionevoli onorari legali derivanti dall’uso da parte dell’utente del Servizio o di qualsiasi violazione di questi Termini e condizioni. 

Informazioni generali

La Società può, a sua esclusiva discrezione, modificare o sostituire uno o qualsiasi dei Termini di utilizzo. Tali modifiche sono vincolanti ed efficaci dalla data di pubblicazione. Di conseguenza, l’utente accetta di rivedere periodicamente i Termini per verificare eventuali modifiche. Traffic tracking 

The Company could collect and store information about your traffic activity using server log files (e.g. IP addresses indirizzi IP, browser type, login/logoff pages, login timestamps, etc.).

Anonymous & aggregate Information

• The Company collects some information on an anonymous basis. The Company also may anonymize the personal information it collects about you.

Our Company will keep your data for declared purposes for 5 years. Once this time period has expired, we will delete all your data.

• to persons in charge of processing, both internal and external to the organization, who perform specific tasks and operations (administration, analysis of data, traffic, etc.)
• in the cases and to the subjects foreseen by the law.

Rights of the data Subject

• La Società, monitora, registra e usa le informazioni relative alla tua posizione, così come altre informazioni ottenute dalla posizione degli hotspot a cui l’utente effettua l’accesso al Servizio, allo scopo di monitorare e migliorare la rete e il Servizio offerto;
• L’utente può’ utilizzare il proprio dispositivo wireless per accedere a una vasta gamma di servizi basati sulla localizzazione approssimativa dell’utente, denominati Location-Based Services, o LBS. Le informazioni che si ricevono in connessione con l’uso di LBS possono includere pubblicità relative alle richieste e alla posizione dell’utente.

Attività di monitoraggio on-line

La Società potrebbe raccogliere e conservare informazioni sulle attività di navigazione (traffico) dell’utente in file log (ad es. indirizzi IP, tipi di browser utilizzati, pagine di accesso/uscita, data e ora di accesso etc.).

Informazioni raccolte in forma anonima e aggregata

• La Società raccoglie alcune informazioni in forma anonima. La Società può’ anche rendere anonime alcune informazioni personali dell’utente.
• La Società può’ utilizzare le informazioni raccolte in forma aggregata a fini statistici e di monitoraggio.
• La Società può’ condividere le informazioni anonime ed aggregate con terze parti di fiducia, ai fini di monitoraggio e miglioramento del servizio.

Informativa sulla privacy dei bambini

Il servizio è rivolto a chi ha compiuto almeno 18 anni; quindi, la politica della Società consiste nell’evitare di raccogliere o usare informazioni personali sui minori di 18 anni, per gli scopi precedenti, a meno che non ottenga prima il permesso dai genitori del minore o dal tutore legale.

Come archiviamo i tuoi dati

La Società archivia in modo sicuro i tuoi dati su cloud Amazon Web Services, in un datacenter a Francoforte, in Germania.
La Società manterrà i tuoi dati per le finalità indicate per 5 anni. Una volta scaduto questo periodo di tempo, eliminerà tutti i tuoi dati.

Categorie di Destinatari
I dati (solo quelli indispensabili) sono comunicati
• a incaricati e responsabili del trattamento, tanto interni all’organizzazione della scrivente, quanto esterni, che svolgono specifici compiti ed operazioni (amministrazione, analisi dei dati di traffico, ecc.)
• nei casi ed ai soggetti previsti dalla legge.

Diritti dell’interessato

In ogni momento potrà: esercitare i Suoi diritti (accesso, rettifica, cancellazione, limitazione, portabilità, opposizione, assenza di processi di decisione automatizzati) quando previsto nei confronti del titolare del trattamento, ai sensi degli artt. dal 15 al 22 del GDPR); proporre reclamo al Garante (www.garanteprivacy.it); qualora il trattamento si basi sul consenso, revocare tale consenso prestato, tenuto conto che la revoca del consenso non pregiudica la liceità del trattamento basata sul consenso prima della revoca.
